State Tax Auditor Arrested On Felony Child Sex Assault Charges

Livermore Police released the following press release Tuesday:

Investigators from the Livermore Police Department received information alleging that Timothy Rodriguez, a 48 year-old Livermore resident, had engaged in continuous unlawful sexual conduct with a 9 year old male.

The incidents began 2-3 years ago and occurred in Livermore as well as out of state. Rodriguez is a registered sex offender and is on full disclosure status on the Megan’s Law website for a previous conviction of PC 288(a) - Lewd Act with a Child.

During a search of Rodriguez’ residence, a 22 caliber rifle was located. Due to the fact that Rodriguez is a convicted felon, he is prohibited from possessing firearms.
Rodriguez was subsequently arrested for:
• One (1) Count of Continuous Sexual Abuse of a Child, a violation of Section
288.5 of the California Penal Code;
• Five (5) Counts of Lewd Act(s) with a Child, a violation of Section 288(a) of
the California Penal Code;
• One (1) Count of Felon in Possession of a Firearm, a violation of Section
29800 (a) (1) of the California Penal Code.

Investigators learned that Rodriguez is currently employed by the State of California as a tax auditor.

On August 6, 2013, Rodriguez was charged by the Alameda County District Attorney’s office with One (1) Count of Section 288.5 of the Penal Code with enhancements of Section(s) 667.71 and 667.6 of the Penal Code. These enhancements could result in sentencing of 25 years to life if Rodriguez is convicted of the charged offense. Additionally, Rodriguez was charged with having a prior felony strike which could double his 25 years to 50 years to life. Rodriguez was also charged with Section 29800(a)(1) of the Penal Code for being a felon in possession of a firearm. This charge results in Rodriguez being held in custody without bail.

At this time, investigators have no information that Rodriguez has victimized any additional children. However, if a parent knows that their child has had contact with Rodriguez, it is recommended that the parent speak with their child about the nature of the contacts.
