Man Killed by ACE Train Had Arrest Warrant for Child Porn

The Alameda County District Attorney's office had charged Eric Hogue, 42, with two felonies.

A 42-year-old Livermore man who was struck and killed by an ACE train on Tuesday night was facing an arrest warrant issued by the Alameda County District Attorney's office for charges of child pornography, Officer Steve Goard said.

According to Goard, Eric Hogue was suspected of possessing and distributing child porn and had been the subject of an investigation conducted by Livermore police investigators since January.

On Jan. 30, officers served a search warrant at Hogue's residence in the 600 block of N. Livermore Avenue. During the search, detectives seized all of Hogue's electronic devices. A search of the electronics by forensic detectives yielded evidence of distribution of child pornography and possession of child pornography. 

Goard says police investigators presented the case to the Alameda County District Attorney's office, who charged Hogue with two felonies, including one count of possessing child pornography and one count of distributing child porn. An arrest warrant was issued for Hogue's arrest. 

"Detectives notified Hogue's attorney of the arrest warrant in an effort to arrange for Hogue to self-surrender," Goard said. 

It is not known if Hogue had been made aware of the warrant at the time of the train collision.

ACE Train spokesperson Thomas Reeves told Patch, via email, that the person on the tracks was a "trespasser." 

The Union Pacific Railroad Police Department is investigating the incident and has not yet been reached for comment.

He did not cost the taxpayers anything. The Fire And Cops, UP officials, and Ace crews were on the job. What he did cost was our precious time, which the deceased used to victimize our waiting children. While I disagree with the method of execution, it is comforting to know, we are down one less Pervert. I do have a request. The next Pervert pleases to announce a day ahead of time, so I can drive for my otherwise Great Commute on the Altamont Commuter Express.

Keep away from Airport runways, freeways, and railroad tracks (except at public crossings). Even experienced track workers - with lineups and flagging - get killed, and the public has neither.

Time is money Philip and, when public safety is busy investigating a train suicide, they aren't patrolling our streets or otherwise being productive for other more deserving victims. I would rather all those involved in the investigation and clean up be handling any number of other issues that directly affect us. If this cretin had simply taken too many sleeping pills, the investigation and impact on the community would have been far less. Nevertheless, I agree that now we and the victims are spared a lengthy trial.

If this was not suicide , but a hate crime homicide, id want to know if we have a psychotic nearby. Who else might he hate? Perhaps a different race than his?, or someone who accidentally hurt him? An investigation, unfortunately, is necessary.

I'm still glad one less pedophile is roaming about. I'll take my flaws of too much junk food, exceeding the speed limit by a couple of mph periodically, and wasting time dreaming hopelessly of smaller government over molesting children thank you.

I hope the train operator and anyone else who had to witness this is doing okay and getting help. Sad that this person had to burden others, both with his sickness and his apparent suicide.

Believe it or not, what came out was a shock to everyone that knew him. Eric was a guy I went to A's games with. I went out and had beers with him. As angry, saddened and disappointed as I am, it doesn't take away the fact he was a dear friend to many people. We all have our demons, his just secretly ran a little deeper. Please do me and all his other friends a favor and shut the hell up. Those that interacted with him are in mourning right now. We lost a friend.

Mike focus on his child porn addiction please and not your beer and A's games with him. Did you guys bring magazines to the games? Sit in the kid section? Did he live near an elementary school playground? Focus on Eric's arrest warrant for child porn. Victims in the photos suffer because demand/supply makes it profitable. Eric's child porn purchases made it profitable to hurt the kids in child porn photo's. Glad he committed suicide. Best decision he made to take his dna out of society. Pray some pediphile priests and youth golf instructors do the same. Bless their hearts.

It's the most offense thing to hear him being called a pedophile. This only happened due to his fear of public opinion over this and the fact he couldn't live with himself. One picture of a 17 year old girl should not have ended like this. It's a damn shame to lose a a great person like Eric. Mourning indeed is what many, many people will do. Please leave the family out of this.

That doesn't sound like one picture of a 17 year old girl. I think somebody is drinking some Kool-Aid and it isn't a good flavor. Anybody who is caught with one picture of a 17 year old isn't going to commit suicide. I have to say, it was somewhat smart on his part. Now there will be no trial and no disclosure of all the evidence. I suppose that shields those "mourning" his death from knowing the full extent of the case.

He mights not be a pedophile but depending on the age of the girl he was lookings at could really be a Hebephile or even a ephebophile. He coulds be a lesser pervert than the regular pedophile but glad he is a goner.

Maurice, he wasn't just "looking." The press release said possession and distribution. That isn't just looking at a picture of a 17 yr. old girl. This case has been going since January which included first a search warrant signed by a judge. That is a fairly high bar to reach in Alameda Co. which required a judge to scrutinize the probable cause for the warrant. After the warrant was served and evidence seized, the DA then reviewed what was found for possible charges to be filed. When a DA reviews a case they throw in many other factors and criteria above and beyond just the Ca. Penal Code sections he may have violated when they decide to proceed. So, I highly doubt that the DA was going to file on just one or two pictures of a 17 year old girl and authorize an arrest warrant for both possessing and distributing. Also, who cares what his particular "philia" was his preference. If you were the parent of any child under the age of 18, you would want swift and painful justice. I concur though that that he did do one final honorable act. Whether intentional or not doesn't matter.

What is there to know other than what has been posted about the charges? Perhaps you should ask yourself what you didn't know "Not God." Having dealt with pedophiles for many years, I have not run into a single case where the relatives didn't show shock, dismay, and disbelief at an arrest for child pornography. Why? Because had you known, you would have either outed him or you would have been an accessory to a criminal act. So, if you are saying that you did not know if he was a pedophile, then how are you qualified to say that was not guilty? Perhaps he was not the person you thought you knew. And, I find it rather implausible that a person will commit suicide if they believe firmly that they are completely innocent. In fact, it has been my experience that innocent people will fight tooth and nail to prove their innocence. But you are welcome to speculate all day long as to his innocence. I'm just glad we don't have to pay for the trial to find out. I'm actually quite happy to leave it up to "God" to hold the trial now. Much cheaper and probably with an irrefutable decision.

He won't ever be tried now will he? Ask yourself why. The police will not air his dirty laundry now that he is dead. What is the point? The only thing I can say about him that is positive is that he saved us money, he saved any potential victims and his family the embarrassment of a trial, and that the police can close the case. Don't you think he knew that when he killed himself? By the way, in court we have judges and juries comprised of our citizens including you and me. That is exactly our job, to judge innocence or guilt and punish or acquit. But you are right that now they will not get a chance. He will be answering to somebody else.

I am content to sit in the peanut gallery and opine as to guilt or innocence. I'll leave the judging, serving on a jury and executing to others. However, if somebody asked me to pull the switch at the prison on a pedophile, I would gladly do so and sleep like a baby afterwards. I also have no problem as a flawed human being being able to point out somebody who is far worse. Not God you seem to want to excuse one of the worst crimes a person can commit, the exploitation of a child, by claiming that just because everybody sins that we shouldn't judge. In my opinion, nothing could be farther from the truth and I believe society has a responsibility to protect children by seeking out pedophiles, prosecuting them and punishing them to the fullest extent of the law.

Also Not God by the way, you can be charged with distributing child pornography if you send it to an undercover police officer. So, he may or may not have sent child porn to another pedophile. He may well have had a conversation with a cop and sent that undercover cop child porn which could result in a distributing charge as he would not have known who the recipient actually was. Or, he may have used a file sharing account where he did not know who the recipients were, nor will the police, just that he posted the files for members to access.
