Man Killed by ACE Train Had Arrest Warrant for Child Porn

The Alameda County District Attorney's office had charged Eric Hogue, 42, with two felonies.

A 42-year-old Livermore man who was struck and killed by an ACE train on Tuesday night was facing an arrest warrant issued by the Alameda County District Attorney's office for charges of child pornography, Officer Steve Goard said.

According to Goard, Eric Hogue was suspected of possessing and distributing child porn and had been the subject of an investigation conducted by Livermore police investigators since January.

On Jan. 30, officers served a search warrant at Hogue's residence in the 600 block of N. Livermore Avenue. During the search, detectives seized all of Hogue's electronic devices. A search of the electronics by forensic detectives yielded evidence of distribution of child pornography and possession of child pornography. 

Goard says police investigators presented the case to the Alameda County District Attorney's office, who charged Hogue with two felonies, including one count of possessing child pornography and one count of distributing child porn. An arrest warrant was issued for Hogue's arrest. 

"Detectives notified Hogue's attorney of the arrest warrant in an effort to arrange for Hogue to self-surrender," Goard said. 

It is not known if Hogue had been made aware of the warrant at the time of the train collision.

ACE Train spokesperson Thomas Reeves told Patch, via email, that the person on the tracks was a "trespasser." 

The Union Pacific Railroad Police Department is investigating the incident and has not yet been reached for comment.

I could be wrong, but I believe suicide is frowned upon by the almighty. Put the possession and distribution aside, and he still burns. Check mate!

I am content to sit in the peanut gallery and opine as to guilt or innocence. I'll leave the judging, serving on a jury and executing to others. However, if somebody asked me to pull the switch at the prison on a pedophile, I would gladly do so and sleep like a baby afterwards. I also have no problem as a flawed human being being able to point out somebody who is far worse. Not God you seem to want to excuse one of the worst crimes a person can commit, the exploitation of a child, by claiming that just because everybody sins that we shouldn't judge. In my opinion, nothing could be farther from the truth and I believe society has a responsibility to protect children by seeking out pedophiles, prosecuting them and punishing them to the fullest extent of the law.

Also Not God by the way, you can be charged with distributing child pornography if you send it to an undercover police officer. So, he may or may not have sent child porn to another pedophile. He may well have had a conversation with a cop and sent that undercover cop child porn which could result in a distributing charge as he would not have known who the recipient actually was. Or, he may have used a file sharing account where he did not know who the recipients were, nor will the police, just that he posted the files for members to access.
