Suspect in Drunken Driving Fatal Crash to Appear in Court

Arraignment for man arrested on suspicion of driving under the influence and causing a fatal head-on collision set for this afternoon.

A 50-year-old man arrested on his birthday after a head-on collision that killed one person early Saturday on State Route 84 is scheduled to appear in court this afternoon.

Santa Clara resident Javier Hernandez faces two felony counts of manslaughter and driving under the influence, said CHP Officer Steve Creel.

"The pickup truck he was driving crossed over a double-yellow line and caused a head-on collision," Creel said. "The collision caused fatal injuries to the driver of the Honda."

That driver was Danny Cabrera of Stockton.

Cabrera, 56, was driving home after a late night at work, according to family comments left on a by Livermore Patch.

"My family is so shock at his tragic death," a person with the username " wrote in the comments section. "He was a good man taken by a person whom decided to get behind a wheel while intoxicated."

A Livermore Patch reader with the user name "Anna Cabrera" identified herself as the victim's daughter in our comments section of the previous report.

"I love & miss you dad. We all do rest in peace," she wrote. "One irresponsible person changed our whole lives tremendously."

The accident was reported at 12:05 a.m. and near a General Electric plant just east of Interstate 680, officials said.

Cabrera was pronounced dead at the scene and the coroner's office was called at 12:26 a.m.

Hernandez is being held at in Dublin. Bail is set at $125,000.

He is scheduled to be arraigned at 1:30 p.m. today in Department 701 at the in Pleasanton.
